Cheeky motherfucker....
I was making a website for a photographer but he's been so slow to give me content it's been stupid, I was hoping to get the site done in about a month but as it is it still isnt finished and its been 2 months, probably a bit longer.
So i sent him an invoice for the work I have done which was paid in deposit up front before I started.
Now he wants his money back or I get taken to court cxause I didn't mention time constraints, but come one, 2 fucking months?
personnally I don't think he's got a leg to stand on, what do you think.

that's the downside to web design, the people that need sites are usually shady...

Just checking some files on my computer, the folder I made for his site was created back in march.
Now, He paid cash deposit so he has no other record apart from the invoice I sent him through email which states paid on it, and I have a full back up of work that I did for his site.
I talked to someone else about this and by the looks of it he's fucked.

It really Isn't in your best interests to follow through with that course of action, legally speaking you don't have a leg to stand on.
If you threaten me with court action and keep emailing me I will file a suit of harrasment.

The only thing he has a right to is the work you got paid to do.Just make sure you save all that stuff you did and keep it handy....the guy sounds shady.
He ain't getting his money back.....lol.....I'd be shocked if you gotten taken to court and lost.Then again I don't know your court system that well by you.

If you didn't mention time constraints he can fire u and get his money back. Ask for money upfront next time. And be clear about ur policies.

What if he tries to use felony's work and claim it as his? I'm guessing Copy right issues could be involved here as well?

he felony has the original files it probably time stamped them with the original creation date, and they guy would have the compressed files with a later time stamp.. case closed...

At the time I didn't think I'd need time constraints, but seeing as how everytime I went there to pick up content he never had it ready.
Seriously, I think I've been pretty patient up untill now.
And sTr is right, the files are timestamped by creation date.
The last website which is unrelated took me about 2 weeks completion, The client for that wants a little tweek to it now and again which I am happy to do, he will also donate some money into my paypal for my trouble.

Well, after the email I sent him he folded.
I'm meeting him on thursday to give him the work I've done on a disc as he's found someone to finish it, I don't care about the copyright, he can have that too, not that theres much to copyright anyhow.

I remember when I worked for a web design company back when I was 18 or 19, we would get shiesty people ALL the time. I remember I busted my ass for 9 hours each day for 4 days in a row since the guy had a deadline for his site. I finished it, then he bitches about the colors when I used the colors he wanted. We sat down and went step by step for planning and he changed his mind, which meant I had to go back and change graphics and coding. Then he had a problem with the online store I set up, saying he didn't like how "easy" I made it. He said I am making his customers feel dumb. Wtf?
He made a $500 deposit for the site, which we required. We said we would have the site done when he wanted it. We began building a Monday morning and he said he wanted the site for Friday afternoon... which meant most of it had to be done by Thursday night. I invited him over to the office Thursday evening when it was complete and he said he was going out to dinner and couldn't. I invited him to the office Friday morning to review the work so I could fix anything by that evening. He didn't show up until 4:30pm, when I leave at 5pm! After all the bullshit, he told me he wasn't paying us for anymore work and that he wanted his $500 back since we didn't have the site ready for Friday evening. Are you kidding? YOU changed it around and showed up late!!
Since I had everything documented electronically or on paper, my boss wanted to take him to small claims for the remainder of the money he owed us. He never paid. We went to small claims and he had a countersuit for the deposit. Since his web site was completed to HIS ORIGINAL want (which was documented), and since it was finished by the deadline, he was denied his countersuit and we were awarded the remainder of the bill.
The key is documentation.

this is why i have kept my web designing more of a hobby than anything. i have been offered to be paid to make a few sites and i turn them down everytime. it's too much of a hassle
i only create sites for myself, and ones as favors to friends. when it comes to trying to make a business from a hobby, and you plan on dealing with strangers (aka customers) make sure you know wtf you're doing, and take all the necessary steps (i.e. contracts and such) before hand
i do charge folks for my modding and video game services, but theres no worries of being sued since they know beforehand that what they're doing is illegal. so that's one advantage
